When exploring 'RV parks near me' for a longer-term stay, understanding the legal framework governing mobile home parks is essential. In Arizona, mobile home parks operate under the Arizona Mobile Home Parks Residential Landlord and Tenant Act (ARS § 33-1401 et seq.), which establishes non-negotiable rights and responsibilities for both tenants and landlords. These regulations ensure a degree of protection and fairness within the community.
Key non-negotiable provisions under Arizona law that apply to Capri MHP LLC, as an 'RV park near me' offering longer-term residency, include:
- Security Deposits: Landlords can charge a maximum of one and a half months' rent for a security deposit, which must be returned within 14 days of vacating, along with an itemized list of any deductions.
- Rent Increases: Residents are entitled to at least 90 days' written notice before any rent increase. The amount of the increase must also adhere to any limitations outlined in the lease agreement or statutory guidelines.
- Termination of Lease: The law specifies valid reasons for lease termination, such as non-payment of rent or violation of lease terms (as per ARS § 33-1482). Tenants are entitled to proper notice and an opportunity to rectify certain breaches.
- Utilities: If the park provides utilities, the lease must clearly detail which utilities are included and the method for calculating any shared utility costs. Landlords are prohibited from terminating utility services as a means of eviction.
- Maintenance and Repairs: Landlords are legally responsible for maintaining the park premises in compliance with local health and safety standards. Tenants have the right to request necessary repairs and may have legal recourse if the landlord fails to address them.
- Discrimination: Arizona's fair housing laws prohibit discrimination based on race, color, religion, sex, national origin, familial status, or disability. These protections cannot be waived or altered by any lease agreement.
- Retaliation Protection: Landlords cannot retaliate against tenants for exercising their legal rights, such as reporting health and safety violations or filing discrimination complaints.
- Right to Privacy: Tenants have a right to privacy within their mobile homes, and landlords must typically provide at least two days' notice before entering, except in emergency situations.

Capri MHP LLC Reviews
Time of post 2024In Arizona, mobile home parks are governed by specific landlord-tenant laws that protect both tenants and landlords. The Arizona Revised Statutes (ARS) contain several provisions that are non-negotiable and cannot be altered by lease agreements. Here are the key aspects of the Arizona Mobile Home Parks Residential Landlord and Tenant Act (ARS § 33-1401 et seq.) that apply to mobile home parks:Non-Negotiable ProvisionsSecurity Deposits:Limit: A landlord can only charge a security deposit of up to one and a half months' rent [2].Return: The landlord must return the security deposit within 14 days after the tenant vacates the premises, along with an itemized statement of deductions.Rent Increases:Landlords must provide at least 90 days' written notice before increasing rent [1].Any rent increase cannot exceed the allowable percentage of increase as defined in the lease or statutory guidelines.Termination of Lease:The law outlines specific grounds for terminating a tenancy, including non-payment of rent, violation of lease terms, or other reasons specified in ARS § 33-1482. Tenants have a right to notice and the opportunity to cure certain breaches before eviction.Utilities:If the landlord provides utilities, the lease must clearly specify which utilities are included and the method of calculation for any shared utilities [1].Landlords cannot terminate utility services as a means of eviction.Maintenance and Repairs:Landlords are responsible for maintaining the premises and ensuring that the mobile home park complies with local health and safety codes [2].Tenants have the right to request repairs and, if the landlord fails to comply, they may be entitled to remedies, including a rent reduction.Discrimination:Fair housing laws prohibit discrimination against tenants based on race, color, religion, sex, national origin, familial status, or disability. These protections cannot be waived or modified by lease agreements.Retaliation Protection:A landlord cannot retaliate against a tenant for exercising their rights under the law, such as filing a complaint regarding health and safety violations or reporting discrimination [2].Right to Privacy:Tenants have the right to privacy in their homes, and landlords must provide notice before entering the mobile home, typically at least two days' notice, unless in emergencies [1].ConclusionThese provisions are designed to protect tenants in mobile home parks in Arizona and ensure fair treatment. Even if lease agreements attempt to modify these rights or responsibilities, these laws remain in effect and enforceable. It's advisable for both tenants and landlords to familiarize themselves with the relevant statutes and seek legal advice if needed.

Oct 30, 2024 · Pablo RamirezThe office managers that have come in are racist and rude to the Hispanics they charge for extra parking by the pool so I can't visit the pool is green and kids can't ever use it because it's open from 8:00 am - 3 pm when the kids are in school and if you want to apply for a mobile home you're going to have to wait a month for them to tell you if you are approved or Not. Horrible management
Sep 14, 2024 · Jackie AtaydeWhen I first moved in it was great the people at the office were helpful. Then as time went by the office staff came and went but after all it's a good place to live. My neighbors are nice we kinda watch out for each other. They have fixed alot of things and the laundry room is nice and affordable. I like it here, I have been very comfortable.
Sep 28, 2021 · Martina MontelongoFor such a bad neighbor I always felt safe and at peace at my home because the manager were very good and friendly with all the tenants any problems they would help resolve. But they did make promises they didnt keep nor made records of them so my trailer never got fixed up like was promised and is still await they have had new managers several times since I lived here and I have begun to feel unsafe in and out of my home, the water is always off and for a stay home mom that becomes an issues they do fine you for everything and there is no parking so if you have more than 2 vehicles your screwed and if you have company there I'd nowhere for them to park you are not allowed to put up a fence so the neighbors kids come in and out of your yard and their animals are unattended and will poop and pee in your yard recently my home has been vandalized twice and I have notified the manager yet no response I hate living here now and cant afford to move at the moment I suffer from anxiety and depression and living here has only made it worst I hope they do something soon to make this place great again if so I will update my review but till than beware .
